Terms of Service

1. The Services

CarAPIs collects vehicle listings published on third-party marketplaces, brings them into one structure, translates the text into English, converts prices to USD alongside the original currency, and makes the result available through the catalogue website, the API and data exports.

The catalogue on carapis.com is an index of listings published elsewhere. We do not own, hold, sell or broker any vehicle. Price, availability and condition are for the seller to state; confirm them at the source before you act on them.

Valuations, price comparisons and import-tax figures are estimates computed from available data. They are not offers, appraisals, or legal, tax or financial advice.

2. Accounts and API keys

• Give accurate information when you register, and keep it current.
• Keep your API keys confidential. You are responsible for all activity under your account and keys.
• Tell us promptly at [email protected] if a key is exposed or used without your permission. We may rotate or revoke a key that appears compromised.
• A key may be used only by you or, for a company account, by your own employees and contractors working for you.

3. Your licence to the data

While your account is in good standing and, for paid plans, your subscription is paid, we grant you a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to access the data and use it in your business, including to:

• analyse it and use it for internal research, pricing and decision-making;
• integrate it into your own systems;
• display listings in your own website or app to your own users.

Photos may be displayed on your own website or app, and resized or cached to serve it. Photos belong to the source marketplace or its users, and watermarks and attributions stay as the source placed them.

An Enterprise agreement or order form may grant different or narrower rights. Where it does, it prevails over this section.

4. What you may not do

• Resell, sublicense or redistribute the data in raw or near-raw form, or offer it as a data feed, API or dataset of your own.
• Use the data or the Services to build or supply a service that competes with CarAPIs.
• Remove, alter or obscure watermarks, copyright notices or other rights-management information in photos or text.
• Share your API keys outside your organisation, or let third parties use the Services through your account.
• Exceed, circumvent or test rate limits, quotas or security measures, or scrape or reverse-engineer our websites and software.
• Use the Services for anything unlawful, including unsolicited messages to sellers or processing personal data without a lawful basis.

5. Source data and your compliance

The listings come from third-party sources and belong to them or their users. CarAPIs grants no ownership of any listing or photo.

You are responsible for making sure that your use of the data complies with the laws that apply to you, including copyright, database rights, consumer protection and data-protection law, and with any rights of the source that apply to your use.

Some listings include a VIN, a registration number or seller-written text, which in some jurisdictions is personal data. If you process such data, you do so as an independent controller and must have a lawful basis for it.

6. Plans, fees and payment

A free plan gives a limited number of API requests per day. A paid subscription is priced by the sources, infrastructure tier, refresh frequency and modules you choose, as shown in the order calculator at my.carapis.com when you place the order.

• Subscriptions run for 30 days (monthly) or 365 days (annual), are paid in advance and are priced in US dollars.
• You can pay by the methods offered at checkout. Annual and Enterprise subscriptions can also be paid by bank transfer against an invoice. A subscription starts when payment is received and confirmed.
• Fees are exclusive of taxes, which are yours to pay where they apply.
• Requests over your daily quota are refused until the quota resets. We do not charge for overages automatically.
• We may change prices for future periods. A change never affects a period you have already paid for.

7. Renewal, cancellation and refunds

• A subscription paid by transfer does not renew automatically. A card subscription, where offered, renews until you cancel it in my.carapis.com.
• You may stop using the Services at any time. Access continues to the end of the period you have paid for.
• An activated subscription is not refunded. A payment that has not been activated yet, such as a wrong amount or a duplicate transfer, is returned or applied to the right order.
• If a fault on our side stops a paying customer’s access for more than a day, we extend the subscription by the days lost, rounded up. A slow or incomplete source is a data issue, not downtime.

8. Availability and data quality

Sources change their sites, restrict access and remove listings, so collection from any source may slow down or pause, and data may be incomplete, delayed or inaccurate. We work to keep the data reliable, but standard plans carry no guarantee of uptime, response time, freshness or coverage.

A service level agreement exists only where an Enterprise agreement sets one out in writing. We may add, change or retire sources and features.

9. Our intellectual property

The Services, including the software, the data schema, the normalisation and enrichment, the documentation and the CarAPIs name and marks, belong to CarAPIs. These Terms give you no rights in them beyond the licence in section 3. If you send us feedback, we may use it without obligation to you.

10. Confidentiality

Each party keeps confidential the non-public information it receives from the other, such as API keys, individual offers and pricing, and non-public documentation. It uses that information only for the Services and discloses it only where the law requires.

11. Disclaimers

The Services and the data are provided "as is" and "as available". To the fullest extent permitted by law, CarAPIs disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, CarAPIs is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.

CarAPIs’s total liability for all claims relating to the Services is limited to the greater of the fees you paid in the 12 months before the claim arose and USD 100. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnification

You will defend and indemnify CarAPIs against claims, losses and costs arising from your use of the data or the Services, your breach of these Terms, or your violation of any law or third-party right.

14. Suspension and termination

We may suspend or close an account that breaches these Terms, fails to pay, puts the Services or other customers at risk, or where the law requires it. Where it is reasonable, we warn you first. On termination for your breach, no fees are refunded.

You may close your account at any time. Sections 4, 5 and 9 to 16 survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. The state and federal courts located in Delaware have exclusive jurisdiction, and both parties consent to it.

Before going to court, contact us at [email protected] and give us 30 days to resolve the matter informally.

If you are a consumer, nothing in these Terms takes away the protection you have under the mandatory law of your country of residence.

16. General

• These Terms, together with any order form or Enterprise agreement, are the whole agreement between you and CarAPIs about the Services. Where they conflict, the order form or Enterprise agreement prevails.
• If a provision is unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver of it.
• You may not assign these Terms without our consent. We may assign them to an affiliate or a successor.
• Neither party is liable for a delay caused by events beyond its reasonable control.
• You confirm that you are not subject to sanctions administered by the United States, the European Union or the United Kingdom, and that you will not use the Services in breach of export-control or sanctions law.
• We may update these Terms. The date at the top shows the current version. We tell paying customers about material changes by email or in my.carapis.com, and continued use after a change takes effect means you accept it.
